Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SnapScribe AI mobile application (the "App") and related services provided by SnapScribe AI ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this minimum age requirement. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App.

2. Account Registration

You may sign in using Google Sign-In or Apple Sign-In. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Credits and Purchases

3.1 Credit System

The App uses a credit-based system. Each photo analysis consumes one (1) credit. New accounts receive 2 free credits upon registration.

3.2 Purchasing Credits

Additional credits may be purchased through in-app purchases processed by Apple's App Store. All purchases are final and non-refundable, except as required by applicable law or Apple's App Store refund policies.

3.3 Credit Expiration

Purchased credits do not expire as long as your account remains active.

3.4 No Refunds

Credits are non-transferable and non-refundable. If you believe you were charged in error, please contact Apple Support, as all billing is managed by Apple.

4. Acceptable Use

You agree not to use the App to:

• Upload, generate, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Upload photos of people without their consent, especially for commercial purposes.
• Infringe any intellectual property rights of others.
• Attempt to reverse-engineer, decompile, or tamper with the App.
• Use automated tools to access the App in an unauthorized manner.
• Violate any applicable local, national, or international law or regulation.
• Generate content that promotes violence, hate speech, discrimination, or illegal activity.

5. User-Generated Content

5.1 Your Content

You retain all ownership rights in photos you upload ("Your Content"). By uploading content, you grant us a limited, non-exclusive, royalty-free license to process Your Content solely for the purpose of providing the App's AI generation services.

5.2 AI-Generated Output

Text descriptions and captions generated by the App ("Generated Content") are provided for your personal and commercial use. We do not claim ownership over Generated Content. However, you are solely responsible for reviewing, editing, and ensuring that any Generated Content complies with applicable laws and does not infringe third-party rights before publishing it.

5.3 Content Accuracy

Generated Content is produced by artificial intelligence and may contain inaccuracies, errors, or unintended content. Always review Generated Content before publishing. We are not liable for any consequences arising from the use of Generated Content.

6. Intellectual Property

The App, including its design, source code, features, and all branding, is the exclusive property of SnapScribe AI and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

7. Third-Party Services

The App integrates third-party services including Google Firebase, OpenAI, Apple Sign-In, and RevenueCat. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party providers.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPSCRIBE AI AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless SnapScribe AI from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the Profile settings in the App.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Apple App Store Additional Terms

The App is distributed through Apple's App Store. The following additional terms apply:

• The app is licensed to you under Apple's Standard End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
• These Terms are between you and SnapScribe AI only, not with Apple.
• Apple has no obligation to provide maintenance or support services for the App.
• Apple is not responsible for any claims relating to the App, including product liability, legal compliance, or consumer protection claims.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
